Certainly, you must report this incident to Tesco's senior management straight away. What happened, in the eyes of the law, is very serious. You have a right to go about your life without being subjected to that sort of treatment. The other thing you must do is obtain the security guard's name and SIA number - these details are on the badge they have to wear when on duty (if he is not employed by Tesco) - and make a formal complaint to the Security Industry Authority (SIA) without any further delay. I am a retired police officer and speaking from experience of dealing with this sort of thing. I wish you every success in obtaining a positive outcome to this matter.

Sam, this matter should have been reported to the police at the time. Firstly, security officers have no power to search your bag. Always insist warranted police officers are called if they wish to do that. Secondly, special constables only have police powers when they are on official police duties. I would pursue the matter with the Professional Standards Department at New Scotland Yard, 5 Broadway, London SW1. Address your letter to the Assistant Commissioner responsible for that department. Best of luck.

I am a retired police officer. Firstly, security officers have no power to search your bag. If goods are advertised at a certain price, that is the price that applies at the point of sale. Tesco cannot ring up a different price and then put the difference back into a customer's bank account. The problem is that companies, like Tesco, are told they can do this by commercial lawyers who are not familiar with other areas of the law. The result is that these lawyers give unqualified advice - advice they are not entirely sure as to its accuracy - and firms like Tesco engage in things like this. Memo to the board of Tescos - change your lawyers before they cost you dearly.

Jlaw, you are absolutely right about the practice being fraudulent and illegal. I also worked in the retail trade before joining the police force. What is described here is NOT theft as there is no evidence or proof of "intent to permanently deprive". Also the ruling in R - Ghosh applies to ALL cases of alleged theft and the test prescribed in R - v - Ghosh have not been satisfied. Therefore, no offence. Tesco have acted totally outside the law. The police officer who attended needs a good hard kick up the backside and sending back to police training college to re-train.

Firstly, I am retired police officer and have studied law since retiring from the police force. To date I have had absolutely no response from Customer Services or the 4 directors I copied in! I also have not received the replacement vouchers that I was assured would be with me within a week! I will NOT be shopping at Tescos again and I will urge others not to as well. As a customer service associate myself, I can catagorically say that their customer service is disgusting.Dear Mr Clarke
I am emailing you to complain about the service received from your Clubcard customer service advisors.
My husband has recently been made unemployed, and is currently in the process of claiming Jobseekers Allowance. Until the payment comes through we are relying solely on my wages to pay our rent, all of our bills and run our household. Thankfully we had some Tesco Clubcard vouchers at home to help out with our monthly shop, otherwise we would’ve struggled to pay for everything.
On Friday 25th November 2011 my husband and I went to Tesco Quedgeley to do our food shopping, armed with the aforementioned vouchers. When we got to the checkout we attempted to pay for our shopping with the vouchers, one of which was for the value of £15, the other £18. However, when the vouchers were scanned we were told that they could not be accepted as they had been re-issued and were no longer valid. We then had to pay for our shopping using money allocated for our bills.
On Saturday 26th November my husband phoned the Clubcard helpline to find out what was happening with the vouchers we had. He was informed that the vouchers we had could be reactivated and they would be active for use after an hour. This was approximately 3:00pm. Later on, about 5:30pm, we went back to Tesco Quedgeley, with the vouchers that we had been assured would be reactivated. We went to pay for our shopping at a self-service checkout, only to be faced with exactly the same message! My husband went to customer services, who disinterestedly informed him that there was nothing they could do there and to phone the helpline, which he did. Nearly 20 minutes later he was told that the vouchers had been reissued that day so there was nothing they could do about it. I eventually took the phone off him to ask to speak to a supervisor. Gavin (user id NS47) told me the same thing and advised that he could only apologise for the completely incorrect information given us earlier that day. I asked what we were supposed to do about the fact that we were stood in the middle of a Tesco store with £15 worth of shopping and no way of paying for it. He replied that I could drive home, go on the internet and print off the vouchers, then drive back to the store and pay for my shopping. As I’m sure you can appreciate, I was furious at this suggestion as I had already wasted time thanks to the misinformation given, money on a 25 minute phone call and now he was telling me to waste even more money on petrol. Not to mention the embarrassment of standing in the middle of a busy supermarket unable to pay for my shopping. I would also like to add, that in the 25 minutes or so that we were stood helplessly by the checkout, not one member of staff approached us to see if we required any assistance. In fact, when I tried to cancel the transaction the young girl assisting on the self-service checkouts, when she was required to come over to authorise the cancellation did not do this, instead she assumed I had made a mistake and returned it to the normal screen without ever having said a word to me!
To add further insult to injury, my husband went onto the Tesco Clubcard website today (Sunday 27th) to print off the vouchers and attempt to buy our shopping again, only to find that the only vouchers available for printing was a single £3 voucher. Towards the bottom of the page, it had a table of vouchers used, stating that there were 2 vouchers one for £15 and one for £18 that had been used in December 2010, but were now processing?!
Needless to say we are extremely confused, upset and angry at the contradictory information given by your Clubcard helpline advisors and your Clubcard website. We now have absolutely no idea if these vouchers are available for use or not, or if we do indeed get the re issued vouchers through the post as advised by Gavin, whether they will even work! We are disgusted with the treatment we have received and have lost all faith in Tesco and their staff. So much for “Every Little Helps”, even a little help during our embarrassment last night would have been nice, instead we were completely ignored, given false information and got the distinct feeling that no one from Tesco gave a stuff about our predicament.
As loyal customers of Tesco, we are sincerely hoping that this horrendous treatment of customers is but a glitch, and you will be eager to compensate us for the distress caused and the money and time wasted as a direct result of the incorrect information given by your incompetent staff. If this, together with a sincere apology, does not occur, we will be forced to make this complaint very public and encourage others to shop elsewhere.
I expect a reply within 5 working days from the date of this email.
Regards
Sarah Goulding (Mrs)

I sent this complaint email to tesco on 28.11.11.
